The authoritarian political system has resulted in a controlled press, particularly since 1958 when the governments Publications Department was goven to censor publications. The authoritarian regime permits the media to discuss society and the machinery of government, but not of the people who hold the political power. This system is built on the theory that truth does not emerge from a great mass of people, but of a few wise men capable of directing and guiding their fellow human beings (Siebert et al, 1963). By claiming to have stabbed Majors, Middlebrooks essentially confessed to killing him. Furthermore, Middlebrooks claimed to have stabbed Majors to puke the victim out of his misery. Not only did Middlebrooks admit to stabbi ng the boy, but he also admitted to stabbing him with the intent of killing him. While Middlebrooks may have viewed his actions as helpful to the boy, albeit gruesomely so, the actions still resulted in Majors death. Middlebrooks argument during the course of his trial was that he only acted the way he had because Brewington, being a larger boy and angrier than Middlebrooks, frightened him. However, he later claimed to have taken part in the stabbing because he wanted to appear cool in front of his tougher friend. Regardless of the reason behind his actions, which kept ever-changing throughout his trial, he still allowed himself to be swayed to the point of taking the life of an innocent boy. Instead of walking away and seeking he lp, or trying to smatter down his friend, Middlebrooks engaged in the beating. Since very little was looked into the role that Brewington played, it would be almost impossible to determine if Middlebrooks was acting of his own accord or if he really was being forced to join in on the torturing of the young man. As it is, simply by standing around as the frenzy took place, Middlebrooks just as well killed Kerrick Majors. This is in regardless of whether he actually physically caused Majors to die or did not seek the help that was desperately needed. Those who stand by and watch someone else die are just as guilty as the person who is causing the damage (Garland & McGowen 21). However, as antecedently stated, Middlebrooks had already admitted to physically harming the boy for the sake of putting him out of his pain. No matter how he tried to condone his actions, someone else died because of his inability to control his own temper and his unwillingness to do something that would ben efit the dying boy. On the other side of the table, it is believed that Middlebrooks had sufficient proof that he was not mentally stable comely to stand trial and therefore was not fit to receive the death sentence (Krzycki), or any such sentence. Witnesses revealed that Middlebrooks had a past of molestation and treat as a child, which caused him to develop borderline personality disorder, schizophrenia, and a psychotic personality disor

The calculation is also based on the premise that the cash flows generated are invested back at the discounted rate which is not a realistic assu mption. The internal rate of return calculation assumes that the returns from the project are re-invested in the project. However, this might not be true in most of the cases. In addition, if the project has multiple positive and negative cash flows, it may have several IRRs. As a result of this, firms shall use modified internal rate of return (MIRR), which is the discount rate that makes the investment equal to the future value of the cash flows from investment (Kierulff, 2008). The actual method used for capital budgeting decisions differ from firm to firm depending upon the size of the firm, the rate of growth of firm and leverage of firm amongst others. Graham and Harvey (2000) in their paper The theory and practice of corporate finance Evidence from the field indicate that net present value and internal rate of return are the most popular methods used for capital budgeting decision methods. They also concluded that there is no dependence of the method used on the growth rate f or firms with smaller debt ratios. Large firms are more than frequent user of NPV as compared to smaller firms. Law of Sale - Case Study ExampleGoing through the facts of the case, we find that there is gap of implied condition on the part of the seller. According to the contract of sale, if there is a sale by sample as well as by definition it is non sufficient that the bulk of goods correspond with the sample if the goods do not correspond with the comment. That is to say, incase of sale by sample as well as interpretation the goods must correspond not only with the sample, they must also correspond with the description given under the contract.Held that the emptors were entitled to demand goods answering the description in the contract, and were not bound to accept the goods tendered merely because they were merchantable under that description. Therefore Susan was being offered the product by the sales assistant by description which later failed to serve the purpose on which she had bought. According to the sale of goods Act 1979, a seller will be held liable were the buyer, expressly or by implication, makes known to the seller the particular purpose for which the goods are required, so as to show that the buyer relies on the sellers skill or judgment and the goods are of a description which it is in the course of the sellers business to supply, there is an implied condition that the goods shall be reasonably fit for such purpose. Further where goods are bought by description from a seller who deals in goods of that description there is an implied condition that the goods shall be of merchantable quality 3 This can further be illustrated Henry Kendall v. William Lillico 1968 2 wholly ER 444 4 where animal food was being made using groundnut extractions from Brazil. The Brazilian food was contaminated by a poison Aflutoxin. At the time there was no reason to suspect that any ground next extractions might contain poison. P, Hardwick game farm, raised pheasant and many of them died from the poison which was contained in food supplied by a local compounder, SAPPA. SAPPA settled but first brought in its suppliers, Grins dale and Lillico who in turn brought in their suppliers, Kendall and Holland. It was Held that on the findings of the judge there was a breach by third parties of the implied condition as to __________________3. Ibid4. www.thomson.com.aufitness of purpose in their sale of the groundnut extractions to SAPPA, and since the extractions were not reasonably fit for use in compound food for poultry and it use in a compound food for pheasants was an ordinary and reasonable use. G. Ltd were liable to indemnity SAPPA in respect of the price done to the plaintiffs pheasants 5 Therefore there is breach of condition on Susans case because she had given description of the product she wanted, but the one that was offered for sale to her did not correspond to her description under the contract. Since Susan had already multi-colored the outside of the cortege with the ever-last masonry paint that later peeled off and being the fact that she had already painted the outside cortege with paint, it means she cannot reject the paint, hence she will be entitled to recover damages. In C.F. Munro & Co. Ltd v. Meyer (1930) 2 KB 312 6 the buyer was held to be entitled to repudiate the whole contract for 1,500 tons of meat and bone meal, when

The former employee would need to prove that these varys in the factory scheduling had no other reason than to discriminate against certain religions. In order to successfully defend against these allegations and respond to the former employees allegations, the company has to show the necessity of the tilt in schedule and why it was inevitable for the management of the company to reverse back the change that was brought about. I look at if we can demonstrate that these changes were necessary for the business needs, we will be successful in our defense. Firstly, product facilities that use a just in time factory schedule for production might get raw material supplies at night. If such a c ompany changes its factory schedule from day hours to night hours, some(a) employees might not prefer the new schedule and would need to quit their jobs. In this case the company has a demonstrated need for a change in schedule and any employee no longer used to the new schedule cannot allege constructive dismissal. Second, instead of getting raw material supplied for production daily, the company shifts to buying raw material in bulk for the next week, in order to be more efficient. Again, the company needs to prove that this change might have not been suitable for certain employees but the change is clearly motivated by business needs rather than discrimination out(p) by the Civil Rights Act of 1964 in order to reply to the employees charge of constructive dismissal. Title 7 of the Civil Rights Act of 1964 provides a comment to religious discrimination by stating that it involves treating a person unfavorably

The linkage between these is a linkage mechanism, which habitual identify as Manager of that particular department. What is the responsibility of manager? In general, the get a line of a manager is to keep a advanced relationship with the employee, without the good relationship, the organisation will unable to run the periodical task to achieve what they got to achieve. The question is how can a manger to change the behaviour of the worker to ways that will match the organisation goals and strategy. Before the implementation of change, we should make sure the manager had got the capacity to handle the change. And there are three questions to ask the manager.Does he return the right lieu?Does he have the appropriate knowledge?Do we have the requirement skill?Right Attitude for the managerA change agent cannot get ahead without expec tant persistence. Change is a hard and laborious process that arouses strong feelings and emotions. Angry people, frustrated teammates, conflicting priorities, unforeseen problems or behind-the-scene resistance pose daily challenges. A project manager cannot lead her team through these minefields without determination and stamina. To avoid mid-course changes in leadership, the person must be fully committed to see the project through completion. A good way to ensure that is to appoint an ambitious individual who presents substantial potential for career advancement within the organization. She will look at the challenge as a terrific career-building opportunity and will be highly motivated to succeed. The benefits will actually extend well beyond the projects time horizon. Indeed, the initiative will provide this high-potential employee with a broader understanding of the business, an extended network of relationships and stronger leadership skills.Appropriate knowledge of what we g oing to changeI am absolute sure that the developer of the strategy do know what is needed to change to meet their target. only when the question is the project manager is in a functional- level of the business, he is a subject matter expert in their respective area of responsibility. Are we sure he got a stop understanding of what is going on of the strategy. An expertise of the strategic goal will be needed to assist the functional level to achieve what they should achieveThe necessary skillsChange is complex subject it will generate lots of pressure due to the instability and un reliablety. And also the manager has to handle manage conflicting priorities, nonuple constituencies and fast-approaching deadline Responsible for gilding the organisation through the numerous challenge of the transition. thereof, the project leader must possess the proven ability to remain highly effective under intense fire. Otherwise, thebreakdown will occur when that person is overseeing a critica l phase, so the whole project can be failed or delayed. Which is fence what we trying to do.Step for implementation of Strategy within the Human ResourceWhat is implementation?Implementation means causing changes to occur somewhere in your field of force of influence as a manager. It is impossible to implement any course of action and not have something change as a result. This means that certain things must be disrupted, discontinues, or deferred and new activities must begin. But most important, it means that after you have initiated action, things will be different. The key is in creating merely the right amount of disruption. The following guide lines should help you to accomplish the implementation of your action plan with the minimum amount of adverse disruption and maximum of success (Responsible Managers Get results- Gerald Faust 1998)Always implement changes from the top down.Always start with the best first.Set your own example.Remember that you cant motivate people to do something they dont know how to do.Recognize and reward desired performance early.Pace implementation so that the timing is consistent with the needs of your plan.Provide coaching and follow-up consulting, and, above all, be persistentStep 1 Planning the Change Process (These step are coming from article How to implement organisation change)Like any complex project, change management requires detailed planning. Being responsible for guiding the process, the change facilitation team must see to it that detailed but realistic planning is undertaken in order to minimize divergence from the vision.Step 2 Goal translationThe executive goals need to be translating to each level of the organisation in a meaningful, achievable target to each individual person within the organisation. For example if the executive goal is increase the sales by 15 %, but how can salesman known how much is the percentage increase for a particular product. Therefore the goals must be SMART (Specific, Measurab le, Additive, Reasonable and Time-bound). Furthermore the goal must is yield to a understandable language of different level of the organisation.Step 3 Barrier identification and RemovalWhen the goals are clearly understood, we can start identifying the barriers that are preventing the achievement of these goals. The people who actually do the work should identify the barrier. Whenever possible, we must involve these people in implementation decision where these view may be crucial. For that reason, Manager must be able to communicate effectively at all levels and across each function.Resistance of Change Employees resist change because they have to learn something new. In many case there is not a disagreement with the benefits of the new process, but rather a fear of the unknown incoming and about their ability to adapt to it. de Jager (2001) argues, Most people are reluctant to leave the familiar behind. We are all suspicious about the unfamiliar we are naturally concerned abou t how we will get from the old to the new, especially if it involves learning something new and risking failure de Jager (2001)Step 4 System for ManagingOnce the goals have been translated and barrier have been identify, the next critical step will be to develop a system for managing the organisation. Traditionally it will only be measured. But now it will be much larger. Not only a metrics need to designed, but meeting need to be developed, measure automation needs to be planned and specific accountability need to be determined. As far as the metrics are concerned, they need to report on goal achievement at each organisation level. And the reporting will also translated to its specificity. So if the executive goal is improved effectiveness of 25 % whence that is what the metrics needs to report on at that organisation level. Similarly the metric in the finished goods packaging area may be case packed per hour and so on.Step 5 Rewards RecognitionRewarding and recognizing employee s is essential to any business or organization. Employees like to know that the work they do is noticed and appreciated by their employers. It is important to recognize both the effort put into getting work and projects completed and the result. Recognition is one of the most effective ways to reinforce an organizations culture, support its objectives, and retain top performers. When we remember to take care of these very human needs for recognition and appreciation, we do a great deal to create an energized workplace we need in order to succeed in todays challenging times.Short Example of implementation SHRM to an organisationAge, skills and trainingASDA will have a range of employees who have worked for different lengths of time and who have different levels of skills and training. The HumanResource planner will seek to have a balance of new people entering ASDA in order to cover those who are leaving. The Human Resource Planner will also want to make sure that skill levels are ra ising within ASDA, and that training programmes are devised to make sure people have the skills to meet ASDAs jobs requirements. If all ASDAs skilled employees are just about to retire, ASDA will have to spend a lot of money on training to build up a new share of expertise.SuccessionSuccession is the way in which one person follows another person into a particular job or role within ASDA. ASDA need to make sure it is grooming people to take on the responsibility required. If ASDA do not do this, it will suddenly find itself with a vacuum cleaner where it has not developed the people to move into the appropriate position of responsibility, and ASDA will be missing the right people in key position to hold ASDA together.Learning organisationToyota is a classics which using a life-long learning opportunity. They understand the current worker may not be able to catch-up with the current technology. Therefore they have introduce a Paid-leave learning period for those who want to going b ack to studyOperating as a learning organization and affording all our employees lifelong learning opportunities and equipping them with the skills and abilities to cope with and develop in an environment of constant change.ConclusionStrategic Human Resource Management (SHRM) is a grandness area. Meaning range from a human resource system that is tailored to the demands of the business strategy to the pattern of planned human resource activities intended to change an organization to achieve its goals. Where in the first definition human resource management is a reactive management field in which humanresource management becomes a tool to implement strategy, in the latter definition it has a proactive function in which human resource activities actually create and shape the business strategy. As Strategy is equal to change, so, SHRM will be change as the changing environment. But one thing can be sure is- SHRM is a managing tool of Human factor which will assist the organization to achieve their goals, and it will controlling all the human factor, and getting the most from them, to optimize the efficiency and gain competitiveness of the organization.Reference1.
